Construction Injury Disability Discrimination Suit Dismissed
Court: Superior Court of California, County of Sacramento
A former employee of our client, a large construction company, alleged in a lawsuit that he was not properly accommodated and was improperly terminated after he suffered a workplace injury to his shoulder and back. Following treatment, the employee had driving limitations and lifting restrictions and our client accommodated the employee with light duty work on a temporary basis. Upon determining that the restrictions were most likely permanent, the employer felt it could not accommodate the employee's restrictions without undue hardship and terminated the employee. After discovery was completed, we obtained complete summary judgment with the court holding that the employer had done everything it needed to do to try to accommodate the employee.
