Laboratory Secures Summary Judgment in Wrongful Termination Action

Court: Superior Court of California, County of Sacramento

A human resources manager sued her former employer, a scientific company that produces and markets antibodies, for wrongful termination, breach of implied covenant of good faith and fair dealing, and fraud under Labor Code section 970. After completing discovery, the defendant moved for summary judgment. The court granted the motion. In her written decision for the defendant, the trial judge complimented counsel “on a well-prepared and articulate argument” and further praised counsel for “exemplifying the model of civil discourse that courts expect but often do not see.”
