Summary Judgment Win in Disability Discrimination Lawsuit

Court:

When our client terminated an employee after she was on a medical leave of absence for over seven months, the former employer filed a lawsuit for disability discrimination, wrongful termination, breach of an implied employment contract, breach of implied covenant of good faith and fair dealing, and negligent infliction of emotional distress under both federal and state laws. Client's motion was granted in its entirety and dismissed with prejudice as the court found, among other things, that Plaintiff was not entitled to an indefinite leave of absence and therefore failed to establish that she was a qualified person with a disability at the time of the alleged discrimination.
